These Terms & Conditions ("Agreement") apply to all photography services provided by Sophia Eerden, sole proprietor based in Innsbruck, Austria.
Scope of Services
Sophia Eerden offers professional outdoor photography services for tourism agencies, travel agencies, outdoor-related brands, outdoor events and magazines. Services are quoted on a project basis, with specific licensing arrangements made according to Client needs.
Delivery of Images
Edited high-resolution images will be delivered through a secure Pixieset gallery within 1 to 4 weeks after the shoot, depending on the scope of the project.
Licensing and Usage Rights
Unless otherwise agreed in writing:
- The Client receives a non-exclusive, non-transferable, wordwide license to use the delivered images on their website and social media channels.
- Use for press, advertising, print, or third-party campaigns requires separate licensing.
- Images may not be shared or sold to third parties (e.g. partners, agencies) without prior permission.
- Sophia Eerden retains full copyright and may use the images for self-promotion (e.g. portfolio, website, social media, awards).
Exclusive or extended usage rights may be granted by separate written agreement.
Travel and Accommodation Costs
Travel is charged at €0.50 per kilometre. Overnight stays are charged €100 per night, unless otherwise agreed.
Cancellations and Rescheduling
Cancellation by the Client:
- Within 1 before the shoot: 90% of the agreed fee is payable
- Within 2 weeks: 50%
- More than 2 weeks: 30%
Rescheduling by the Client (excluding weahter or health-related reasons):
- If postponed within 10 days before the shoot, a 20% rebooking fee will be charged.
Cancellation or postponement by Sophia (due to illness, weather or unforeseen circumstances):
- The shoot will be rescheduled
- If rescheduling is not possible or not desired, assistance will be provided in finding a suitable replacement photographer
- Any payments already made will be fully refunded in case Sophia has to cancel or cannot perform the rescheduled photoshoot.
Liability and Satisfaction Guarantee
Sophia Eerden takes all reasonable care and professional diligence in producing and delivering photographic work.
- In the unlikely event of complete dissatisfaction with the final images, and if no viable solution can be found, Sophia Eerden may refund up to 70% of the invoiced amount at her discretion.
- Liability for incidental damages, indirect losses, or use beyond the agreed scope is explicitly excluded.
- Total liability is limited to the amount paid by the Client for the specific project.
Payment Terms
- Invoices are issued upon delivery of the final gallery.
- Full payment is due within 14 days of the invoice date.
- Late payments may incur reminder fees or interest charges in accordance with § 456 UGB (Austrian Commercial Code).
Legal Framework
- These Terms & Conditions are governed by the laws of the Republic of Austria.
- Place of jurisdiction for any disputes is Innsbruck, Austria.
- Should any provision of this agreement be or become invalid, the remainder shall remain unaffected.
Additional Notes
- When photographing identifiable individuals, model releases will be obtained where required.
- Drone photography is carried out in accordance with local regulations and applicable licensing (in compliance with EASA guidelines).
